Car Seat Belt Law Requirments?
Since 1983 you must wear a seat belt if one is fitted and the driver is responsible for ensuring that any passenger under the age of fourteen is properly restrained. This became the law in 1983.
Failure by parents to abide by these rules may mean that the child, by way of seperate legal representation, may be entitled to make no win no fee personal injury compensation claims against the parents or driver of the vehicle.
Children less than three years of age travelling in the front seat of any vehicle must be carried in an approved and appropriate child restraint. Adult belts on their own must not be used.
If a child restraint is fitted in the front, but not the rear, children under three must use that restraint.
If an appropriate seat belt or child restraint is available in the front, but not in the rear, children aged between three and eleven and under 1.5m in height must use the front seat belt or restraint.
Which Vehicles does Car Seat Belt Law Affect?
Front seats of all vehicles, including vans coaches buses and goods vehicles where belts are fitted. Rear seats of cars and small minibuses (with an unladen weight of 2540Kgs or less) where seat belts are fitted. Cars were required to have seat belts fitted in the front seats from April 1967 and in the rear seats from 1987. Buses and coaches used to transport children were required to have seatbelts fitted from 1996. Failure to use a seatbelt in the event of a collision may mean that damages awarded in a no win no fee personal injury compensation claim will be reduced by a substantial percentage on the basis of contributory negligence.
What if There Are More Passengers Than Belts?
Car seat belt law does not prevented you from carrying more passengers than there are restraints. However, certain considerations must be taken into account when deciding who should ride without a restraint. Heavier passengers will cause greater injury to themselves and other occupants if they are thrown forward in a crash. If you have to choose between a child and adult to wear the belt, always choose the heavier passenger.
