SPEED CAMERA LOCATION - CAR ACCIDENT CLAIM
New legal regulations require speed cameras to be highly visible by painting them yellow and cameras must not be obscured by road signs, bridges, trees or bushes. They must be clearly visible from 60m where the speed limit is 40mph or below, and from 100m in all other areas. Warning signs must be placed within 1km of cameras. Camera site visibility must be reviewed every six months. Mobile camera operators must wear fluorescent clothing. The cameras must only be sited where either four people have been killed or seriously injured in the previous three years, or where there have been eight 'personal injury accidents' within 500 metres either side of the camera over the previous three years. If the police fail to abide by these requirements an RTA solicitor may be able to defend a charge of speeding. POLICE DRINK DRIVE POWERS Drinking and Driving is an all year round problem and Police Forces in many areas now routinely breath test anyone involved in a traffic accident. Many drinkers still take a chance because they believe that they can get away with it, but sooner or later most drunks will be caught. HAND HELD TELEPHONE PROHIBITION
From 1 December 2003 it has been an offence for motor car drivers to hold a mobile phone in your hand or prop it between your cheek and shoulder when driving, even if both hands are on the wheel. A ‘touch phone’ is allowed – for example, to press a button to receive a call however once the phone is picked up an offence is commited. Drivers are advised to fit a dashboard phone cradle to remove any doubt about whether or not the phone is being held.
